Terms of Service
These terms are a legal agreement between you and Famasia Limited. Please read them carefully before using our services.

By creating an account or using the Famasia services (the website famasia.app, console.famasia.app, admin.famasia.app, and the iOS/Android mobile app), you accept these terms.
1. Definitions
- “Famasia” / “we” means Famasia Limited, a company registered in Tanzania.
- “Services”: the website, mobile apps, and APIs we provide.
- “User” / “you” means a person or company that has registered an account with Famasia.
- “Plan”: the payment plan you choose, such as Month, 3 Months, 6 Months, Year.
2. Account registration
- You must be 18 years of age or older and have the legal authority to run a business in Tanzania.
- Provide accurate and truthful information when registering. Providing false information is against the law.
- You are responsible for protecting your PIN. Do not share your PIN with anyone else. Any activity on your account is presumed to be yours.
- We may delete your account immediately if you breach these terms.
3. Plans and payments
3.1 Free trial
New accounts get 2 days of free use without having to provide payment details. After 2 days you must choose a plan to continue using the service.
3.2 Payments and refunds
- Plan prices are shown on the pricing page and are calculated in Tanzanian Shillings (TZS).
- Payments are collected in advance (pre-paid). A plan cancelled before it ends is not refunded, unless Famasia failed to provide the service because of our own fault.
- Payments use Selcom as the payment processor. We accept M-Pesa, Tigo Pesa, Airtel Money and bank cards.
- A payment receipt is sent automatically to your account.
3.3 Changing or cancelling
You can change or cancel your plan at any time through settings. Changing to a higher plan takes effect immediately; changing to a lower plan takes effect at the start of the next billing period. Cancelling ensures you will not be charged again after the current period ends.
4. Acceptable use
You agree not to do the following:
- Use the service for any illegal activity.
- Attempt to access another person's account, or damage our systems (intrusion, denial-of-service, etc.).
- Copy, steal, or resell any part of the service without our written permission.
- Use the service for trade in illegal or fraudulent medicines, or medicines not approved by the Tanzania Medicines & Medical Devices Authority (TMDA).
- Upload any content that is defamatory, inciting, or that infringes another person's intellectual property rights.
5. Intellectual property
- Famasia owns the software, code, design, logo, and website content. You have no permission to copy, distribute, or modify them without our permission.
- The data you upload (medicines, sales, your customers) is yours. We store it only as a processor.
6. Privacy
How we handle your information is described in the Privacy Policy, which is part of these terms.
7. Service as provided
We try to keep the service running at all times. However, the services are provided “as is”. We do not promise that the services will never be interrupted, will be error-free, or will be suitable for your particular purpose.
8. Limitation of liability
To the extent permitted by law, Famasia will not be liable for any loss arising from:
- System failure, delays, or unavailability of the service.
- Data errors caused by the user entering incorrect information.
- Actions of third parties (Selcom, AT, AWS, Vercel, etc.).
- Indirect loss (loss of profit, opportunity, reputation, etc.).
The maximum compensation under these terms is equal to the total payments you made to Famasia in the 12 months before the event that gave rise to the complaint.
9. Deleting your account
You can delete your account at any time through settings or by following the instructions at Delete your account. We may also delete your account for the following reasons, after notifying you at least 14 days in advance (except in emergencies):
- Breach of these terms.
- Failure to pay for a plan for more than 30 days.
- Activity that endangers the security or integrity of the service.
10. Changes to the terms
We may change these terms. We will notify you of significant changes by email at least 14 days before they take effect. Continuing to use the service after the changes means you accept them.
11. Governing law
These terms are governed by the laws of the United Republic of Tanzania. Any dispute arising from these terms will first be handled through friendly discussion; if that fails, it will be taken to the Commercial Court of Dar es Salaam.
